Indiana has one Native American casino, Four Winds Casino, located in South Bend. All other casinos are state-licensed.
One of the state-licensed casinos, Hard Rock Casino Northern Indiana, will be branded and managed by Hard Rock International, which is owned by the Seminole Tribe of Florida.
There are three federally-recognized Cherokee tribes or bands. Only one issues per capita payments to their adult members. This is Eastern Band. They don't give out monthly checks, but disburse bi-annual allotments, that will fluctuate with tribal.

The tribal government's Indian tribe does not have a reservation, or the principal place where the tribal government meets to conduct tribal business is not on the reservation because the reservation does not have a building or lacks essential utility services necessary to meet and conduct tribal business. One additional casino (the Lytton Rancheria of California's casino in Contra Costa County) operated only Class II devices, which does not require a compact with the state. There are some tribes with ratified compacts that do not have a casino, and other tribes have had casinos in development since March 2006. Federal law provides tribes that operate casinos with sovereignty that limits the ability of the state to dictate how they operate on Indian land. Newsom's letter referred to that issue in.
A new gaming law effective July 1, 2019 legalizes sports betting at casinos and mobile devices, allows live-dealer table games at racetracks, and authorizes construction of two new casinos, one in Gary and the other in Terre Haute.

When the state legislature approved land-based casinos in 2015, it included a provision to approve an Indian casino in South Bend.
In April 2016 the South Bend city government approved a deal with the Pokagon Band of Potawatomi Indians to build a $400 million casino in their town. An environment impact report was finished for federal review and accepted.
The key milestone to proceed with this casino project came in November 2016 when the Bureau Of Indian Affairs gave its approval. Their decision transfered 166 acres of Pokagon Band land into federal trust under the U.S. Interior Department and included federal approval to build a Class II gaming casino.
The federal Indian Gaming Regulatory Act (IGRA) defines Class II gaming as gambling played against other players only and not the house. This includes electronic slot machines that play against other players. Slot machines that play against the house are Class III gaming.
For Class III gaming the Pokagon Band must negotiate a gaming compact with the State defining specific casino games and the money the casino will pay to the state. Federal review and approval of the compact is required.
The Pokagon Band has named their casino 'Four Winds Casino South Bend'. It is the first Native American casino in Indiana.

Indiana launches sports betting
September 5, 2019
Indiana sports betting was launched at noon Sunday September 1. Only in-person betting at licensed locations are accepted at this time. Online and mobile betting will be available later in the football season.
The first three locations to accept sports wagers were Ameristar Casino in East Chicago, Hollywood Casino, and Indiana Grand. These casinos will soon be joined by five more licensed locations:

Indiana passes sports betting and 2 new casinos

Gov. Eric Holcomb signed legislation authorizes sports betting including online gambling, liv-dealer table games at racetracks and construction of new casinos in Gary and Terre Haute.
Indiana is the ninth state to allow sports betting and the third this year. The first sports betting could start as soon as September 1. Minimum betting age is 21. Mobile devices that register with an state-licensed casino can place online bets.
Live-dealer table games will now be allowed at Harrah's Hoosier Park northeast of Indianapolis and Indiana Grand Racing & Casino in Shelbyville beginning Jan. 1, 2020.
The law allows Spectacle Entertainment, which owns two casino licenses in Gary, to replace the Majestic Star Casino on Lake Michigan with a $300 million casino along the Interstate 80/94 corridor in Gary. The second license would be returned to the state and issued for construction of a new casino in Terre Haute.

Indiana Gaming Agreement Passed by Legislature

The Indiana Senate and House both voted today in favor on a new gaming agreement that will that will bring major changes to the state.

SPORTS BETTING
The Indiana Gaming Commission will set up rules for using professional sports data in sports betting. Mobile sports betting are approved for anyone 21 years or older. Players must register at a licensed gaming location or a state-approved online website.

Live dealers will be allowed at Harrah's Hoosier Park northeast of Indianapolis and Indiana Grand Racing & Casino in Shelbyville beginning Jan. 1, 2020.
TERRE HAUTE CASINO
One of the two Gary casino licenses owned by Spectacle Entertainment will be transferred to Vigo County if a voter referendum approves the move. Applicants for building a Terra Haute casino would have to invest $150 million to Vigo County for expenses and related amenities. The new casino will receive $40 million in tax credits over the first five years.
The Senate vote in favor of the legislation was 37-12 and the House was 59-36. The bill is now waiting for Gov. Eric Holcomb's signature.

Publication 146, Sales to American Indians and Sales in Indian Country, is primarily a guide to the proper application of California's Sales and Use Tax Law to transactions occurring in Indian country in California that involve both Indians and non-Indians. Among other things, it includes information on transactions involving construction contractors and property used in self-governance as discussed below.
If you are an Indian residing in Indian country, or you are an Indian having a construction contract performed in Indian country, you may use the following exemption certificates to provide documentation to the retailer that the sale in question is to an Indian residing in Indian country.
- CDTFA-146-RES, Exemption Certificate and Statement of Delivery in Indian Country
- CDTFA-146-CC, Construction Contract Exemption Certificate and Statement of Delivery in Indian Country
Regulation 1616, Federal Areas, provides a sales and use tax exemption for sales of property used in tribal self-governance. To qualify for this exemption, all of the following criteria must be met:
- The sale must be to a tribal government of an Indian tribe that is officially recognized by the United States,
- The tribal government's Indian tribe does not have a reservation, or the principal place where the tribal government meets to conduct tribal business is not on the reservation because the reservation does not have a building or lacks essential utility services necessary to meet and conduct tribal business,
- The property is purchased by the tribal government for use in tribal self-governance, and
- Title to the property transfers and the property is delivered to the tribal government at the principal place where the tribal government meets to conduct tribal business.
Since the tribal government may take title and possession of property outside of Indian country and still qualify as an exempt transaction under the circumstances outlined above, a retailer may verify that the address at which title to the property will transfer is valid by examining the list below. This list contains tribal governments along with the address at which they meet to conduct tribal business that are outside Indian country. Additionally, the retailer should obtain an exemption certificate from the tribal government as supporting documentation for the exempt sale. Tribal governments may use CDTFA-146-TSG, Exemption Certificate – Property Used in Tribal Self-Governance and Statement of Delivery, as part of the necessary documentation to retailers that the sale meets the criteria for the exemption as outlined above.
